Infringement flowchart description
If an infringement offence occurs, the first stage in the infringement process is the issuing of an infringement notice to the offender.
If the infringement penalty is paid, no further action is taken against the offender and the matter is finalised. If the infringement penalty is not paid and no court election is made and no application for internal review is made, the matter proceeds to stage 2, which is the issuing of a Penalty Reminder Notice. If this happens, an additional cost of $24.50 will be applied to the original infringement penalty.
If, after the issuing of a Penalty Reminder Notice, the infringement penalty and the additional costs are paid, no further action is taken against the offender and the matter is finalised. If the infringement penalty and the additional costs are not paid and no court election is made and no application for internal review is made, the matter proceeds to stage 3, which is the lodgement of the Infringement Notice with the Infringements Court. If this happens, and enforcement order is issued by the Infringements Court, which requires payment of all outstanding amounts plus an additional cost of $81.60.
If, after the issuing of an Enforcement Order, the infringement penalty and all additional costs are paid, no further action is taken against the offender and the matter is finalised. If the infringement penalty and all additional costs are not paid, the Infringements Court can issue an Infringement Warrant. This adds a further cost of $59.80. If the infringement penalty and the additional costs are paid, not further action is taken against the offender and the matter is finalised. If the infringement penalty and all additional costs are not paid, the Sheriff can take enforcement action against the offender.
